Benchmark Air Conditioning & Heating is proud to provide air conditioning and heating services to our fellow citizens of the North Dallas and Collin County area, including the cities of Addison, Allen, Carrollton, Celina, Frisco, Highland Park, Lewisville, McKinney, Little Elm, Plano, Prosper and The Colony.

Attached to our installation proposal and agreement is our No Lemon Guarantee. For your convenience, we have duplicated a copy on our website below.

To provide our customers with "Peace of Mind" that should come with an investment in a new home comfort system
16 SEER and above, we proudly provide you with the following "No Lemons" guarantees:

No Lemon Guarantee
NO LEMONS – AIR CONDITIONER
If the compressor in the outside air conditioner fails within 5 years of the date of our installation, we promise to replace the entire outside air conditioner – at no cost to you.

NO LEMONS – FURNACE
If the furnace heat exchanger in the newly installed home comfort system fails within 10 years of the date of our installation, we promise to replace the entire furnace – at no cost to you.

Terms & Conditions
The "No Lemons" guarantees shall apply only so long as:

  1. The entire furnace and condensing unit is professionally tuned-up annually by a service technician.
  2. NO person or company other than the seller provides any type of service or maintenance on any portion of the furnace and condensing unit.
  3. All repairs recommended by the seller are performed on the unit
  4. The home remains owned by the person for whom the unit is installed and the home is occupied at all times subsequent to the installation.
  5. The furnace and the condensing unit has been used solely for the purpose and under the conditions for which it was designed and has not been subjected to misuse, alteration, accident, or abuse;
  6. The No Lemons Guarantee certificate is presented to the seller upon compressor heat exchanger failure.
A "failure" under this guarantee shall not include any malfunction of the compressor or heat exchanger which is beyond the seller’s reasonable control including, without limitation, any act of God, act of buyer, fire, accident, flood, or other natural disaster.

The terms and conditions of the No Lemons Guarantee are limited to those presented in writing on the face of this document with writing is intended as the final complete and exclusive statement of the seller’s duties and obligations under this guarantee.

The Guarantee and the terms and conditions hereof shall be governed by and construed according to the laws of the state in which this guarantee is made.

All other warranties, express or implied, including the warranty of merchantability or the warranty of fitness for a particular purpose, are hereby disclaimed. Buyer’s remedy is limited to performance under this warranty, up to the purchase price paid for the product covered hereunder. Seller shall not be liable for incidental or consequential damages.
